Article 1 – Definitions
In these terms and conditions:
- Consumer: A natural person who is not acting for purposes related to their trade, business, craft, or profession.
- Day: A calendar day.
- Digital Content: Data produced and delivered in digital form.
- Durable Medium: Any tool, including email, that enables the consumer or entrepreneur to store information in a way that allows future consultation or use for a period appropriate to its intended purpose, ensuring unaltered reproduction.
- Entrepreneur: House of LaPé.
- Distance Contract: A contract concluded between the entrepreneur and the consumer within an organized system for remote sales of products, digital content, and/or services, utilizing one or more remote communication techniques until the contract is finalized.
- Model Withdrawal Form: The European standard withdrawal form in Annex I of these terms and conditions. This annex is not required if the consumer has no right of withdrawal.
- Remote Communication Technology: Any means used to conclude a contract without requiring the entrepreneur and consumer to be in the same physical location simultaneously.

Article 3 – Applicability
- These general terms and conditions apply to all offers from the entrepreneur and all distance contracts between the entrepreneur and the consumer.
- Before concluding a distance contract, the consumer will have access to these terms and conditions. If providing them beforehand is not reasonably possible, House of LaPé will indicate how they can be accessed and will send them free of charge upon request.
- These terms and conditions are available on the website under the “General Terms and Conditions” section.
Article 4 – The Offer
- If an offer is time-limited or subject to conditions, this will be explicitly stated.
- The offer includes a complete and accurate description of the products, digital content, and/or services provided. Descriptions will be detailed enough for the consumer to make an informed decision. Any images used will be a true representation of the products or content. House of LaPé is not bound by obvious errors in the offer.
- Each offer will clearly state the consumer’s rights and obligations upon acceptance.
Article 5 – The Agreement
- The agreement is established when the consumer accepts the offer and meets its conditions.
- After payment, the consumer is obligated to purchase the product.
- If an offer is accepted electronically, the entrepreneur will promptly confirm receipt. Until confirmation is received, the consumer may cancel the agreement.
- If the agreement is concluded electronically, House of LaPé will ensure secure data transfer and a safe web environment. If the consumer makes electronic payments, appropriate security measures will be taken.
- House of LaPé may assess whether the consumer can meet their payment obligations before finalizing the agreement. If there is reason to decline the agreement, the entrepreneur may refuse the order or impose special conditions.
- Upon delivery of the product, service, or digital content, House of LaPé will provide written confirmation of:
a. The right of withdrawal (if applicable) or a clear statement if withdrawal is excluded.
b. Warranty information and after-sales services (if applicable).
c. The total price, including taxes, delivery costs (if applicable), and payment and fulfillment methods.
Article 6 – Exclusion of the Right of Withdrawal
House of LaPé excludes the right of withdrawal for its products. This absolutely applies to custom-made items and custom-made denim jackets. These cannot be exchanged.
Article 7 – Pricing
- During the validity period of an offer, the prices of products and services will not increase, except for changes in VAT rates.
- Prices subject to financial market fluctuations, beyond House of LaPé’s control, may vary. This will be stated in the offer.
- Price increases within three months of the agreement are only allowed if required by law.
- Price increases beyond three months of the agreement are permitted if:
a. They are due to legal regulations, or
b. There is an increase in material costs. - Product prices include VAT.
Article 8 – Compliance with Agreement and Additional Warranty
- House of LaPé guarantees that its products meet the agreement, descriptions in the offer, reasonable quality standards, and legal requirements at the time of sale.
- The entrepreneur is not liable for:
- Incorrect use of products.
- Color and quality loss of denim, beads, or sequins due to improper washing.
- Color and quality deterioration of ceramic and porcelain items if washed in a dishwasher.
Article 9 – Delivery and Execution
- House of LaPé will take the utmost care in processing and fulfilling orders.
- Orders will only be shipped after full payment is received.
- If delivery is delayed or an order cannot be completed, the consumer will be informed.
- When shipping fragile items, we cannot guarantee against breakage during transport. The shipment of these items is entirely at the Buyer’s risk.
Article 10 – Payment
- Payments must be made in full at the time of order placement.
- Consumers must report any inaccuracies in payment details immediately.
Article 11 – Complaints Procedure
- Complaints can be submitted via email to House of LaPé.
- Complaints will be addressed within 14 days. If a response requires more time, the consumer will be informed when to expect a detailed reply.
Article 12 – Disputes
All agreements between House of LaPé and the consumer are governed exclusively by Dutch law.
Article 13 – Additional or Deviating Provisions
Any additional or deviating provisions will not be to the consumer’s disadvantage and must be recorded in writing or stored on a durable medium accessible to the consumer.
